Basically what this could mean is the players won't be eligible. You have to have rosters set 24 hours before kickoff so theoretically changing a ruling even for 24 hours at this stage could cause LSU big problems. Pate broke it down on Sunday's show.

Dawg, we're already back to college football. USC's backups gave up 23 points to SJSU in one quarter last weekend, and either Bill Belichick has a defense again or TCU's offense is making 2010s Kansas look competent.
Those are the sorts of things that one loves to be able to say about college football when it's back.

What does that even state a claim for?
Getting players to pursue lawsuits over rules even if it happened wouldn’t be something for courts to get into, especially when the controversy over those rules is legitimate

u/BoldElDavo Virginia Cavaliers 17h ago
In its complaint, the SEC requests the court “enter a preliminary and permanent injunction prohibiting Defendants from violating the Conference’s First Amendment rights by compelling the Conference to associate with conduct that is contrary to the Conference’s purpose and mission.”

It’s different because it doesn’t even make sense as a lawsuit
What relief are they really asking for against lsu/kiffin? They aren’t bringing the lawsuit and do not have the power to stop it
If the state court finds the ncaa/sec rules are unlawful, whatever this lawsuit is trying to do wouldn’t get in the way of that
I’ve pursued novel legal theories, but this is just not based on legal reality as far as I can tell

First amendment rights aren't just free speech, but freedom of association. Which includes being able to set rules around membership in private organizations, like an athletic conference, so long as they aren't protected classes like race, gender, religion, etc.
By breaking SEC rules to sign these players, LSU is infringing upon the other 15 members rights to freedom of association because they all agreed to abide by the SECs rules to be part of the organization.

In its complaint, the SEC requests the court “enter a preliminary and permanent injunction prohibiting Defendants from violating the Conference’s First Amendment rights by compelling the Conference to associate with conduct that is contrary to the Conference’s purpose and mission.”
Interesting 1st Amendment claim. I’m not really sure how being compelled to honor a contract for competition among sports is a violation of the 1st Amendment. I think the theory that because LSU is a State university that having a state run college forcing them to compete with NFL players is synonymous with compelled speech.
If this were a private university, then there would be a no claim since you could just seek another remedy.
As a CFB fan and a lawyer, this is going to be fun to watch.

The Southeastern Conference has filed a lawsuit in the U.S. District Court for the Northern District of Alabama against Louisiana State University and head coach Lane Kiffin, according to documents obtained by On3. LSU president Wade Rousse, athletic director Verge Ausberry and Kiffin are named defendants.
The news comes the same day as a preliminary injunction hearing in Baton Rouge, where the judge is expected to decide whether the temporary restraining order would remain in place until a trial date is set. If the injunction is granted, it would give LSU legal standing to play former Ole Miss and NFL players Zxavian Harris and Dae'Quan Wright. LSU opens the 2026 season on Saturday night in a top-25 matchup against Clemson.
