In its complaint, the SEC requests the court “enter a preliminary and permanent injunction prohibiting Defendants from violating the Conference’s First Amendment rights by compelling the Conference to associate with conduct that is contrary to the Conference’s purpose and mission.”

Interesting 1st Amendment claim. I’m not really sure how being compelled to honor a contract for competition among sports is a violation of the 1st Amendment. I think the theory that because LSU is a State university that having a state run college forcing them to compete with NFL players is synonymous with compelled speech.

If this were a private university, then there would be a no claim since you could just seek another remedy.

As a CFB fan and a lawyer, this is going to be fun to watch.

My understanding and what I’ve seen written about this, is this is going to relate to freedom to set competition under their bylaws.

Effectively the private competition they run is collegiate players, that’s it. You’re now getting Louisiana trying to force them to allow individuals who graduated, declared, and went professional, and are now seeking to return to play. And the conference/NCAA has for decades been against that.

So by forcing them to play professionals, you’ve gone against their actual mission and forced them to violate their own bylaws/competition standards. It’s not about pay, since they’re not dictating pay, it’s about ability to set eligibility of competition.

I think part of that is why Kiffin did the side comment of “it’s not ineligible to practice, it’s only just play”. If Julio Jones wants to run some routes in Tuscaloosa for fun the NCAA/SEC doesn’t care. They just don’t want him in their actual competition.

I don’t know how the euro basketball stuff changes this since a few played last year that were college age. Maybe a domestic pro league thing?

Being enrolled as a student doesn't change anything.

The SEC explicitly bans member schools from putting an athlete on a team roster if the player:

• Declared for the NFL, NBA, or WNBA draft and did not withdraw on time/without repaying agent benefits.
• Signed a contract with a professional league (for football or basketball).
• Was listed on a professional team roster or training camp
