Source document (Judicial order): https://documents.lastweekinlaw.com/view/gov.uscourts.txsd.1928300.165.0.pdf

The "just don't go" line is ¶83, p. 33. Dolly Parton appears at ¶¶56, 59, 65(d). Holdings: facially overbroad under Moody, facially vague under Roy; Paxton's motion for new trial denied.

The r/law mod team is working on permanently hosting original source documents, along with limited annotations to help give readers give additional context.

What a concept. Freedom of choice.

893

u/AlphaNoodlz 8d ago

It's a difficult concept for Republicans

u/Chance-Deer-7995 8d ago

Hey! Republicans believe in Freedom of Choice. You're free to make the choices they want you to.

Always wanted to try that American gladiators course with the air guns firing tennis balls or whatever, looked fun

3

Assault. It was by far my favorite course as well.

2

u/QbertsRube 8d ago

We used to play a version where the "contestant" would move from station to station firing various Nerf guns at the "Gladiatior" who was behind a chair firing plastic GI Joe missiles at the contestant with a crossbow. Not sure how we still have all of our eyeballs, but it was fun!

The party of small government 😑 Republicans have to know that the gen pop will never take them seriously again. In a decade they’ve abandoned almost every single professed belief that have.

10

u/AsinineArchon 8d ago

Unfortunately the general population in the US has been trained to pick teams, not beliefs. If the republican platform is wishy-washy, then the people are too. People follow the party, not anything else

And that is VERY intentional by the ones who fear the people

I'll never forget Rush Limbaugh being absolutely baffled that liberals just think anybody should be able to have whatever kind of sex they want "as long as there's consent." Like yeah dude...that's kind of the whole point.

(seriously, this is a real quote)

“If there is consent on both or all three or all four, however many are involved in the sex act, it’s perfectly fine," Limbaugh said. "Whatever it is. But if the left ever senses and smells that there’s no consent in part of the equation then here come the rape police. But consent is the magic key to the left."

17

u/Biptoslipdi 8d ago

The "rape police." Also known as "the police."

Limbaugh was such a piece of shit.

11

u/-rosa-azul- 8d ago

Heh, bold of you to assume police are anything but hot garbage when it comes to rape cases.

But yeah, he was a piece of shit. And now he's dead and the world is better for it.

Texas Republicans are some of the most anti-freedom MFs I've ever met.

A once great state ruined by 30 years of Republican oppression and stupidity.

53

u/the_shadowmind 8d ago

When was Texas ever great? They started as a land rebelling against Mexico,  because they wanted to keep slavery.

25

u/iamsotiredofthiscrap 8d ago

Everyone remembers the Alamo, but they don’t know why they remember it.

31

u/quillseek 8d ago

Seriously. I went to San Antonio for a business trip a few years ago and was excited to see the Alamo, this key piece of American history. Realized I didn't really remember much about its significance so thought I would do a little reading ahead of my visit and that turned into one of those "wtf"-inducing, 37-tabs-open Internet deep dives.

The Texans were the bad guys.

24

u/iamsotiredofthiscrap 8d ago

They're the reason Lincoln had to send union troops to enforce emancipation. Juneteenth wouldn't exist without Texas.

Oh great, thanks a lot... I remember learning about the Alamo in 4th grade, all we were taught were that Texans fought bravely against all odds and were defeated at the Alamo so now we remember their bravery with the famous slogan. Hopefully I'm misremembering, because my impression was that the Texans were under siege by INDIANS hahaha, I definitely have no recollection from 4th grade of Texas ever being a Mexican territory, nor the Alamo battle being a separatist conflict.

A federal judge in Texas struck down Texas Senate Bill 12, a 2023 law restricting drag shows, ruling that it violated the First Amendment by improperly limiting protected speech.

Judge David Hittner blocked Attorney General Ken Paxton from enforcing the law, which could have fined businesses up to $10,000 for hosting events, and charged performers with a Class A misdemeanor punishable by up to a year in jail. Hittner said the law was overly broad and vague, potentially sweeping in activities such as cheerleading, dancing and live theater. He also told people offended by such performances that the simple solution was: “just don’t go.”

158

u/Kodiak01 8d ago

Which shines a spotlight on why following the same path with mail-in voting only plays into Benito The Cheeto's hands. The goal is not just to deny rights, but to violate them, potentially life-harming, then fight it out after the fact. The damage would already have been done.

21

u/oritfx 8d ago

Respectfully I disagree. IMHO Trump does not know the law while being 100% that his perception of the law is perfectly sufficient to run things, and also impossible to be convinced otherwise.

So he just decrees stuff like a tzar of a mafia boss, because that's what he thinks the justice system is like.

I disagree because I really don't believe there to be any plan from him. There wasn't any, ever. He just goes by gut feel and impulse of whatever seems good at the moment.

99

u/bassdude85 8d ago

He does go by gut feeling, but the Heritage Foundation and the rest of the people who write his EOs don't

15

u/oritfx 8d ago

I have to agree here. I don't think he reads or writes those.

24

u/Mike_Kermin 8d ago

As long as you're not confusing your idea for thinking he isn't malicious and doesn't know what he's doing.

People call him stupid, but, they have the wrong thinking.

Stupid is 'if he wasn't ,he'd do better."

But the reality is, if he were smarter, he'd harm more.

So 'stupid' isn't the problem, it's the fascist racist hate politics, the self enriching the lack of any morality and the intentional covering up of child abuse.

So, he might not know the rules around voting, but his people do, and he's very keen to fuck you with it.

3

u/carlotta3121 8d ago

It's never been Trump's plan, he's just the mouthpiece.

The plan is decades old, born of FedSoc, Heritage, and the hundreds of foundations "charitably" funded by billionaires with the purpose of influencing academia, Congress, the courts, statehouse, and presidents for their own benefit.

To be fair, since they keep letting him get away with most of the shit he pulls, that kind of is what the justice system is like now that he's captured it.

3

u/YBBlorekeeper 8d ago

As much as Trump is paraded as the strongman, he's not operating alone. Conniving people in his cabinet and inner circle are the ones who feed him ideas like this. He loves it because he gets to pretend he knows wtf is going on.

Trump may be too fucking stupid to understand how "the gun" actually works, but there are people pointing him into the right direction and placing his finger on the trigger.

u/stevez_86 8d ago

That is the whole thing to them. Years in court over nothing, and then they will move on as if they didn't try to have the government try to ban specific kinds of people from public. Or they just execute the law anyway and spend more time in court.

They don't need to ask for permission anymore because when they just do it they don't even need to ask for forgiveness.

I want to say that is why illegal laws need to have ramifications for the people that passed them, but with this US Supreme Court they would make it ok for Republicans to ban Democrats from being in government. They would rule a law a Democrat passed as illegal and punish the Democrats as a whole. That is their MO.

37

u/gentlemanidiot 8d ago

Why, you're almost making it sound as though SCOTUS is a captured, hyperpartisan, unreliable entity

11

u/stevez_86 8d ago

I don't know why but I really think John Roberts, Samuel Alito, and Clarence Thomas really identify with the Brer Rabbit.

Does anyone remember the Tale of the Brer Rabbit and the Tar Baby?

Basically they are the Brer Rabbit (Antebellum Southern Democrats/Confederates) and the Tar Baby is the Civil War. They picked a sensless fight and lost and got stuck with a Tar Baby all over their fur.

The only way to get rid of the Tar Baby is to be thrown into the Briar Patch. And the best person to do it to them is the Brer Fox.

John Roberts wrote a Talking Points Memo (not the news site) for the Reagan Administration which outlined how he thinks the Federal Government should view Voting Rights and the Voting Rights Act. He has always been this way, waiting for the opportunity to execute his judo on the results of the Civil War and Reconstruction and Federal Civil Rights and everything else.

Like I said before they know how to make the Democrats do things that gets rid of the Tar Baby little by little.

For Roberts, Alito, and Thomas, they saw the beginning of the throw into the Briar Patch with Obama winning.

How could a Federal Government led by an Elected Black Man be racist? No better time to review the situation to make sure nothing in the Federal Government is founded under the principle that the Nation, the Federal Government is and was institutionally racist.

All the huge decisions since then have been an audit to see if there was an underlying acceptance of a no longer existent institutional racism. Or discrimination at all. And if that is the case then anything that is found with that is really discrimination against white people, whom they see as the opposing party to those who have experienced discrimination. If minorities were benefited incorrectly then white people were harmed. Only white people have claim to damage under this new doctrine.

They are listening to the Confederate side of the argument for Federal Government now and ruling bit by bit that the Confederates had it right. And if you remove the Civil War then that philosophy should be supported where the people want it.

I fear the Democrats' effort to gerrymander in retaliation is exactly what they want. They big toss into the Briar Patch. If the Democrats start doing what Republicans were stopped from doing because of the Voting Rights Act, it is discriminatory to the Republicans across the nation to let the Democrats do the same exact thing in their states? We elected a black guy! How can Democrats cry racism exists still! I can hear the argument without them speaking a word.

It is actually just a big Save Scum to get the US back to the style of government just before the Civil War, set the game back up for Civil War, and if Civil War doesn't happen again then Confederacy gets a fair (rigged in its favor) trial again. And they will say it was right all along.

And if that is the case, then we are basically a new nation and Trump hasn't served a term under that nation. So he gets to run and serve 2 more terms.

3

u/tawDry_Union2272 8d ago

don't threaten them with a good time...

4

u/gentlemanidiot 8d ago

That's an extremely ominous hypothetical, here's hoping you're wrong. 😬

6

u/shponglespore 8d ago

The mistake we made wasn't that we failed to build a system that couldn't be abused by malicious actors; it's that we gave malicious actors unfettered access to the levers of power. No system can survive that.

23

u/Hatetotellya 8d ago

Dont worry the next slightly worded differently law that does the same thing (or worse) will only take another three years, followed by another and another

8

u/AerialDarkguy 8d ago

Yep, they knew they would lose but are fine milking it for those 3 years, harassing and ruining lives over it, and dragging it out as long as they can. Even the losing ruling doesnt punish them. The moral panic moved on to trans kids so the constituents dont care and will play the same game ctrl + f, ctrl + v a few words for another few years.

16

u/Warm_Month_1309 8d ago

And all it took was three years

It's complicated. The law was passed in 2023 and declared unconstitutional after a few months in September of 2023 and blocked from enforcement. Then in November of 2025, the 5th Circuit unblocked the law and remanded it back to the District Court for reassessment. Now it has been blocked again.

So the ban wasn't in effect for three years. It was in effect for a few months, then not in effect for two years, then in effect for a few more months.

What a great use of resources, huh?

The funny thing is that Boomers were watching Bob Hope and Flip Wilson do drag comedy all the time. Now suddenly it's the bane of a good Christian society?

79

u/licoricenipple 8d ago

Two of the biggest comedies for boomers were MASH (in the US) and Monty Python (in the UK) and they both had drag in just about every episode.

Did you ever find Bugs Bunny attractive when he put on a dress and played girl bunny?

No, I just thought it was funny. But I am a well adjusted (HA!) gay man and not a republican.

11

u/apple_kicks 8d ago

Christians get to change what they are mad about every few generations. First it was black people being free, then women getting rights, then black people getting rights, then gay people getting rights. Once they lose the trans fight they will pick an even smaller minority to hate. They are trained to be professional victims since infancy at the church.

2

u/Wast3edSpace 8d ago

Some needed it to stay on-stage and the cognitive dissonance really hit hard when they were confronted by people from whom it is an identity 24/7. Rather than work through that they cast them out as 'the other' which was like a moral opiate that made it easier.

2

u/CommentsOnOccasion 8d ago

Because it is only funny to them when it’s open mockery of the drag itself

A drag queen is not the same thing as a comedian temporarily wearing drag as a bit

So they see drag queens as mentally unwell or even demonic (or groomers or whatever other boogeyman shit they’ve been fed to help get conservatives elected)

But when Trump buried his face in Giuliani’s fake drag tits on camera, it’s funny to them because the drag itself is the funny part.

It’s not gender bending artistic expression, it’s just juvenile mockery comedy.

I never really understood the difference between drag shows and those child beauty pagents. Why is one ok and the other not? Arent they pretty similar in idea?

56

u/Jimberly_C 8d ago

Pretty sure child beauty pagents are much more likely to cause harm than drag shows.

12

u/PaulFThumpkins 8d ago

They're fine with harm, and people being exploited. Predators can be excused and forgiven. They're not fine with people displaying their alternative identity for themselves.

34

u/Sad_Expert2 8d ago

Arent they pretty similar in idea?

No - drag shows are just entertainment. Like a variety show. There's not a competition theme to them or an emphasis on judging people of any shape/size on what they look like. (obviously everything has a competitive side, just like there are singing competitions and concerts still exist - there are shows like Drag Race)

Drag shows are often fundraisers too. The last one I attended was just a dance for anyone, and in the middle they stopped and had a drag show. The queens came around collecting money, and the money went to a women's shelter in my area.

4

u/fallenouroboros 8d ago

Thats kinda what I’m getting at. Its like backwards.

6

u/the_dankest_sauce 8d ago

I think you're morally right but have it backwards yourself. child beauty pageants should never fucking exist in the first place. drag shows are harmless dudes dressing outrageously, you can tell they're men. 10

u/fallenouroboros 8d ago

And yet drag shows are the ones that get nailed to the cross its so weird to me

6

u/ImprobableAsterisk 8d ago

I mean the major difference I see is that one involves adults performing, the other has children performing. Even if all else was equal, and it ain't, that's enough of a difference to treat them differently.

To me that's a pretty substantial difference and should make it easy to distinguish from a law policy perspective.

3

u/fallenouroboros 8d ago

Exactly its weird! And 1 is considered this sacred thing while the other just corrupts kids, but i swear someone swapped arguements when talking about the two

6

u/kandoras 8d ago

In the one Republicans want to ban, everyone involved is a consenting adult. And if someone tries to sneak backstage to spy on them while they're getting dressed, that person would be kicked out.

That's the difference. I'll let you decide if it answers the question of why they think one is OK and the other should be banned.

Hypocrisy is the central pillar of fascism, and fascists say wrong things on purpose.

I really wish more people could get this through their fucking skulls already.

u/slarker22 8d ago

This is the exasperating part. People don't reallize there exists no gotcha or logic that will lever a person that is actively acting with malice. The things they say aren't out of ignorance but with vile purpose.

5

u/RocketRelm 8d ago

Malice and obliviousness go hand in hand, not knowing is deliberate. Be it foreign authoritarians or domestic fascists, be it alt right or alt left trying to take over the more moderate versions of their party, the populism follows the same road of tribal affiliation first and working backwards and ignoring everything contradicting.

They don’t care about freedom.  The GOP loves to wave shiny balks / jingle keys to distract from actually important stuff.  These fringe wedge issues distract morons and have worked for decades.

This would make Dolly Parton so happy to hear. What a great tribute the universe just gave her. 🥰

74

u/taktaga7-0-0 8d ago

It was handed down yesterday. Maybe she knew.

10

u/Miserable_Mail_5741 8d ago

She was an LGBT+ ally through and through.

I bet she attended tons of drag shows in her lifetime and would oppose the law if she was aware of it.

26

u/TaijiInstitute 8d ago

Holy shit. I just learned about her passing from your post, that was a gut punch. RIP Dolly, you’re a legend.

u/ldubs 8d ago

I found out yesterday when I joined a meeting with cameras on... so everyone could see the tears welling up in my eyes. 🥺

You could tell who in the meeting was too busy to look at their phone.

Finally, a ruling that makes sense.

51

u/AdorableSobah 8d ago

Judge talking to them like the children they’re being, it’s refreshing when it seems like this entire country has lost its mind.

79

u/Long-Region5088 8d ago

“I don’t have to do things I don’t like? But those things exist and I don’t like them so they should be illegal” is the general mindset

14

u/aduckdidit 8d ago

Won't somebody think of the children!

15

u/Long-Region5088 8d ago

The type of people who vilify drag queens while also protecting multiple child rapists? Oh they’re thinking about the children alright

u/vigbiorn 8d ago

Are you sure the mindset isn't more like an addict demanding others don't do their addiction because it being available is too much temptation.

Granted, in this situation most addicts are smart/not entitled enough to realize they should just separate themselves from that environment instead of demand everyone else change.

2

u/Nahteh 8d ago

Victimless crimes. How do you feel about drugs guns and prostitution?

I am anti fireworks though most of all strangely enough.

I just don’t like them I don’t want them illegal. Regulated and safe? Sure. But not illegal

"Just don't..." could apply to most republican talking points.

Abortion = just dont have one

Drag shows = just dont go

Voting by mail = just dont vote by mail

College "indoctrination " = just dont goto college

...

29

u/darkstar999 8d ago

Women's sports, they already don't go. But they need to "protect" it.

11

u/ogresarelikeonions93 8d ago

Saw a video on Tik Tok and the creator is asking the protestors outside of a WNBA game to name 5 WNBA players. Only one could name anyone and it was Sophie Cunningham and Caitlin Clark 🫠

Using Republican logic against them, LOL.

49

u/Dapper_Magpie 8d ago

They've dropped the pretense of freedom a while ago, if they ever really had it in the first place. Not sure why people won't stop saying shit like "you claim to like freedom and yet you're passing laws to force religion in schools and to take away the rights queer people, women, immigrants, etc etc. Erm, hypocrite much?" as a gotcha. They know what they're doing, they aren't hiding that they want certain people gone or dead, and pointing out that they're scum won't stop them.

10

u/BagSalt7633 8d ago

The 'freedom' thing is just something they when they're out of power. When they're in power, they go full Puritan.

Same as the deficit.

There is no such thing as Republican logic.

79

u/dude496 8d ago

If this goes the same way that every other good judgement has gone recently, an appeals court will somehow find a reason to reinstate the ban... This timeline sucks

18

u/PM_Me_Your_Kinks369 8d ago

Yup! It'll go to a higher level judge that loves Trump and corruption and this will be overturned, I suspect.

Should it? No.

Will it? Probably.

That's just the world Trump and MAGA have brought to us.

25

u/AimlessClimber 8d ago

I hope none of them enjoy theater, because women have played male roles since forever. No broadway for them!

13

u/caifaisai 8d ago

Don't give them ideas. I'm sure a lot of these people would be ecstatic at the idea of shutting down Broadway along with all that "queer" musical theater.

5

u/Unique-Yoghurt4170 8d ago

Yeah uh... I'm pretty sure the Nazis in texas don't give a shit about theater lol.

9

u/JustWow52 8d ago

I believe that women in the theater is a relatively new thing. Like in the last 2-300 years or so.

"Theater" meaning dramatic enactment, as opposed to "showbiz"

There have always been female performers, but in another kind of theatrical production.

My great-uncle was in a highly-acclaimed drama club in college in the 1930s. They wrote and produced original shows and then performed in a limited major-city tour.

Membership in the club was not open to women, and I have a picture of this uncle in a chorus line of men, all in full drag.

3

u/napstablooky2 8d ago

males have played female roles since forever*

some parts of shakespeare's works are even a bit tongue-in-cheek about the fact that the female characters are going to be played by young boys

You know what most southern states have not banned?

KKK Rallies. I don’t think they’ve even tried.

28

u/Logizmo 8d ago

Haven't banned Beauty Pageants either, it's always so funny to me that reading books to kids is so horrible yet putting 5 year old Tina in a bikini and 10 lbs of makeup to be judged by a panel of 50+ year old men is perfectly fine.

So fine the President has been apart of multiple and owns his own Pageant...

Things are really bad, huh?
