It will be interesting to watch unfold at the federal level. All state schools possess sovereign immunity thanks to the 11th Amendment - so already a promising foothold for 14 of the remaining teams who wish to contest. Additionally, a state judge in Louisiana is going to struggle to enforce any order outside of state jurisdiction - and with the SEC office one state over - good luck in their efforts.

Since the SEC is a voluntary association of members with the ability to exercise rights as a collective, the rights of the collective members would have protection under the 1st Amendment via freedom of speech clause.

This gives the SEC members the ability to disassociate itself from LSU at will - as the state institutions minus Vanderbilt already possess sovereign immunity at many levels and no forcible coercion can be used to control a freedom of speech related boycott by those institutions. In the end, no state or federal level judge will be able to block this if the conference wishes to move to this level of recourse. The SEC could effectively remove LSU via a boycott.

I have a hard time imagining any judge allowing the SEC to punish LSU for what a judge said they could do. If the SEC won their case, LSU wouldn't be able to continue to roster them, but there's no way a judge is going to allow them to be retroactively punished.

There's zero fuckup to the timing, these athletes just didn't like it. Rules change after guys graduate all the time, tough shit.

There's got to be a cutoff somewhere.

The class of 2022 exhausted their eligibility under the rules they played and graduated under. Same thing happened to the class of 2021 who didn't play under COVID exemptions, and the classes before 2018 with the previous redshirt rules.

I don't get to go to the store to get a price change on the food I bought last week because they have new deals this week.

Real answer, this is mostly employment law and anti trust regulation. Judges don't touch on field sporting rules (apart from stuff that could obviously endanger players with no sporting reason, like requiring to suck on a piece of lead while playing) but roster decisions and eligibility for professional sports (which College Football is now) has always been up for courts to rule on.

Right but say LSU comes to Florida and plays the players. In Florida the current rule is they are not eligible (I don’t think there has been a suit but who knows). So in the eyes of the NCAA and SEC they played ineligible players and can be punished but not in Texas or Louisiana? This is why these should be federal cases honestly- the jurisdiction is a mess

The NCAA and SEC are free to set eligibility rules, so long as those rules don't contradict standing employment laws.

You know how we got free agency in baseball and football? Court cases. You know how we got players unions in sports? Court cases.

The people running things always want to take all the money and leave none for the players and make up really terrible rules about what they are and aren't allowed to do. Every sports league you follow has been shaped by dozens of court cases. It's always been in the hands of the courts.

All of this would have been avoided if the NCAA changed their rules to allow a full 5 years with better timing.  They have their own lawyers.  It was stupid to create a pool of players that have a legitimate legal argument. 

Others may disagree, but with NIL and some players in college making more than some pros, the difference between a college player and a pro player is not like it was even a decade ago.

While I don’t think there’s a snowballs chance in hell the SEC will remove LSU, I would bet money LSU leads the league in penalties this season while simultaneously having the least amount of penalties called against their opponents.

There are ways for the SEC to punish LSU, but they won’t kick them out.

The spigot regarding eligibility has not been shut off. It is so easy to envision how some player scrounging around in the UFL wouldn’t go to court to get their “year,” especially if you do it in the State Court where the school recruiting you is located. The precedent being set is awful and will not end with the class of 2022. Parasites like Heitner exist for a reason; to grift and continuously push the envelope until dudes like Kedarius Toney are suiting up.

Sure it has, Bedacko lost. The guy who’s been in the UFL for years will lose also.

It’s literally just applying the rule that the NCAA was talking about for months to the guys who finished school a month before. It played out this way with the NCAA fighting 2022 players because coaches didn’t want to manage their rosters with 2022 guys so the NCAA passed an unreasonable rule. The result is the NCAA/SEC getting predictably smacked down in court.

Which on one hand, yes, it does make Kiffin being so willing to die on the hill ridiculous, but that goes just as much the other way. Everybody is pretending that this is the MLS outbidding a euro league for Messi when they're really going to be like the 30th best player on LSU's roster.
